Welcome to trakr.hockey ("trakr", "we", "us", or "our"). By accessing or using our hockey tracking platform and any related services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). Please read them carefully.
If you do not agree to these Terms, you must not access or use the Service. By creating an account, you confirm that you are at least 18 years of age, or that you are using the Service under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.
trakr is a hockey analytics and team management platform that enables coaches, managers, and sports organisations to track game statistics, manage rosters, record video footage, operate live scoreboards, and analyse player and team performance data.
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:
The Service allows you to upload, submit, store, and share content including video footage, game data, player information, and other materials ("User Content"). You retain ownership of any intellectual property rights you hold in your User Content.
By submitting User Content to the Service, you grant trakr a non-exclusive, worldwide, royalty-free licence to host, store, process, and display that content solely for the purpose of providing the Service to you and your organisation. We will not use your User Content for advertising or any other purpose beyond operating the Service.

When you enter information about players, athletes, or other individuals into the Service — including names, positions, statistics, or other personal details — you accept full responsibility for ensuring you have the legal right and appropriate consent to collect, store, and process that data within the platform.
If player data relates to individuals under the age of 13 (or the applicable age of digital consent in your jurisdiction), you are responsible for obtaining verifiable parental or guardian consent before entering that information. trakr assumes no liability for your failure to obtain such consent.
All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, icons, images, and the overall design — are owned by trakr or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose in accordance with these Terms. You must not copy, modify, distribute, sell, or create derivative works based on any part of the Service without our prior written consent.
The Service may integrate with or contain links to third-party websites, tools, or services. These integrations are provided for convenience only. trakr does not endorse and is not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and governed by those parties' terms and policies.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content available through the Service.
To the fullest extent permitted by applicable law, trakr and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of revenue, loss of profits, or loss of goodwill — arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
In no event shall our total aggregate liability to you for all claims arising out of or relating to the Service exceed the greater of (a) the total amount you paid to us in the twelve (12) months preceding the claim, or (b) one hundred Canadian dollars (CAD $100).
You agree to indemnify, defend, and hold harmless trakr and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we determine that you have violated these Terms. Upon termination, your right to use the Service will immediately cease.
You may terminate your account at any time by contacting us at support@trakr.hockey. Sections of these Terms that by their nature should survive termination (including but not limited to intellectual property, disclaimers, limitation of liability, and indemnification) shall survive.
These Terms shall be governed by and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Nova Scotia for the resolution of any disputes arising out of or relating to these Terms or the Service.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. For material changes, we will make reasonable efforts to notify you — such as by email or by posting a notice within the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
